Peekaboo Photo Booth, LLC Terms of Service
Your order on peekaboophotobooth.com sets forth an agreement between Peekaboo Photo Booth, LLC, (Provider), and you (Client), hereinafter sometimes referred to as the parties, for photography services for an event at (address entered by you in your order.) These Terms of Service set forth a written agreement of the parties and supersedes all other written and/or oral agreements between the parties.
The Service Period will be from the times entered by you, specified in your order. You may change the service period times for your event date, provided we have availability. Provider agrees to have a Photo Booth operational for a minimum of 90% during this period. Occasionally, operations may need to be interrupted for maintenance. Set up and break down time is included with every service. The service period you select ensures the service will be provided during those times. We arrive and set up before the service period and break down immediately after the service period, unless otherwise agreed upon. Idle hours can be purchased if you would like the booth to be set up but not in use before or after the service period.
A non-refundable deposit in the amount of 50% of the total price is due to reserve the event date. If the client selects the deposit payment option at checkout, the client will be emailed a link immediately where the final balance payment can be made. If the client does not pay the balance at least 10 days prior to the event date, the remaining balance will be charged to Client’s Credit Card on file 9 days before the event. If booking within 9 days of your event date, payment in full is required to reserve service. If you pay a deposit 9 days or less from your event date, we will charge your card on file to ensure you are paid in full as the event will be quickly approaching. Client must be paid in full before the event date, otherwise Provider reserves the right cancel the service and Client will not be entitled to a refund for any payments made to Provider.
Provider does not accept checks from private individuals and businesses. Checks are accepted for government entities and schools.
Client will pay a $100.00 fee for any and all returned checks which Client may write to Provider as payment for any service by Provider.
ACCESS, SPACE & POWER
Client will arrange for an appropriate space for the Photo Booth at event’s venue. The space shall be no less than 5’ L x 8’ W x 8’ H. Client is responsible for providing power for the Photo Booth. (110V, 10 amps, regular 3 prong outlet). If ample space is not provided, Provider will not be responsible for additional service time due to relocation of the photo booth. If ample space is not provided, client will not receive a refund and all payments will be forfeited. Client will be responsible for payment in full if ample space is not provided.
DATE CHANGES & CANCELLATIONS
Any request for a date change must be made in writing to provider at least thirty days in advance of the original event date. Change is subject to photo booth availability. If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled. Any cancellation occurring less than thirty days prior to the event date shall forfeit all payments received.
Client agrees to, and understands the following:
a) Client indemnifies Provider against any and all liability related to Client’s Event during and after Client’s event. Client will indemnify Provider from the time of service and on into the future, against any liability associated with the Client and provider’s attorney’s fees and costs related to any dispute.
b) Client indemnifies Provider against any and all liability associated with the use of pictures taken within the Photo Booth, its’ representatives, employees or affiliates at Client’s event.
DAMAGE TO PROVIDER’S EQUIPMENT
Client acknowledges that it shall be responsible for any damage or loss to the Provider’s Equipment caused by: a) Any misuse of the Provider’s Equipment by Client or its guests, or b) Any theft or disaster. If in any case, the client or guests are found to be responsible for damaging the photo booth at an event, the client will not be entitled to a refund.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision, or portion thereof, shall be deemed severed from the rest of this contract and shall not effect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to resolve any dispute via arbitration. In the event Provider is unable to supply a working Photo Booth for at least 90% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on site the Provider will be allowed to print the photos after the event and mail them to the client free of charge. In addition, the Provider will be allowed to host the event images on our web gallery for the client where their guests can download and share the digital files for their own use.
If a disc is included in the client’s package and is not given at the event the provider will email a link to the client where all the event prints can be downloaded at no charge.
If Client has purchased a scrapbook package the onsite photo tech will encourage guests to help compile the scrapbook by placing a photo strip in the scrapbook and writing a note. The photo tech cannot force the guests to place their printed pictures in the scrapbook. Provider does not guarantee that all printed pictures will be in the scrapbook. The photo tech will do their best to ensure the book is completed as best as possible.
If no service is received, Provider’s maximum liability will be the return of all payments received from Client. Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
REPLACEMENT IMAGES / PURCHASING IMAGES AFTER THE EVENT
The Client has 30 days to notify Provider regarding damaged discs. Provider does not mail replacement discs. Provider will email a link with all the images to the client if a disc is defective. If Client wishes to purchase images after the event, Provider will email a link of all the images and charge a fee of $25.
The Client is responsible for paying any parking fees associated with the event.
Outdoor events are acceptable. However, no refund will be given due to inclement weather. Provider suggests securing a backup indoor location in case in rains, snows, is too hot, etc.
Direct sunlight in warm or hot conditions is bad for electronic equipment. Our photo booths cannot be set up in direct sunlight on warm or hot days.
Peekaboo Photo Booths can not be set up outside if conditions are wet.
If Client’s event service period is 3 hours or greater the Client is required to provide our onsite photo tech a vendor meal.
Client understands and agrees to be bound by the terms of these terms of service. Client understands that there is a minimum 50% deposit and is required to select the Terms of service checkbox on peekaboophotobooth.com to reserve service.
